Subject: [GLOBAL-L] Singapore court rules definitively in JMD's favor

Dear All,

Attached and below is the final landmark verdict in World Sports Group's
legal proceedings against me. The court ruled fully in my favour and
rejected all requests for disclosure of sources or information. This is the
final rendering, there is no appeal by either party possible. In short, I
won with particular thanks to my lawyers, Straits Law and George Hwang, as
well as Media Defence and the International Federation of Journalists who
supported me in this process.

Best regards,

James

Singapore
World Cup report 'leak': WSG seeks names k c vijayan
528 words
14 September 2012
Straits Times
STIMES
English
(c) 2012 Singapore Press Holdings Limited World Sports Group asks court to
order journalist to reveal sources A VETERAN journalist could face court
action to disclose the source that allegedly leaked a private and
confidential auditor's report.
The 2012 report about the Singapore-based World Sports Group (WSG) was
addressed to the Asian Football Confederation (AFC).
WSG is seeking a High Court order against the journalist, Mr James Dorsey,
to name the source or sources he quoted in his recent blog post titled "Fifa
investigates: World Cup host Qatar in the hot seat". He also tweeted on the
topic last month.
In court papers filed last week, WSG said the auditor's report was prepared
by PriceWaterhouseCoopers Advisory Services on the instructions of the AFC.
Its position is that the confidential report contained certain statements
defamatory of the WSG which were subsequently divulged to various media
organisations. There was no mention in the court papers that they were
linked to Mr Dorsey's blog post.
The other matter allegedly leaked to Mr Dorsey involved a confidential
agreement between the AFC and WSG.
WSG wants to know whether he had a copy of the report, whether any third
parties were involved and whether conditions were imposed on him for the use
of information from the report.
When contacted yesterday, Mr Dorsey made it clear he will "vigorously
resist" the court application, which requires him to answer a list of six
questions if approved by the court.
He is a senior research fellow at the S. Rajaratnam School of International
Studies of Nanyang Technological University and is also a syndicated
columnist who blogged about the case yesterday.
A High Court hearing due yesterday was adjourned to enable his lawyer, Mr N.
Sreenivasan, to file defence papers in response to WSG's application.
The group is a leading Asian sports marketing, media and event management
company and provides commercial rights, sales and services in connection
with sporting events throughout Asia and the Middle East.
The AFC is the organiser and official governing body of football in Asia,
Australia and the Middle East, and stages several competitions in the
region. WSG has had contractual links with the AFC since 1993, and has
signed a pact to manage commercial rights to AFC competitions between 2013
and 2020.
In court papers filed by its lawyer, Senior Counsel Deborah Bar-ker, WSG
wants the information from Mr Dorsey in order to sue the parties for the
leaks, which involved alleged defamation.
It pointed out, among other things, that the fact he was able to quote
verbatim on his Twitter account from the report showed he had a copy.
The suit, filed last week, was preceded by a letter from Senior Counsel
Barker last month to Mr Dorsey demanding an apology.
It had alleged that his "distorted and unsubstantiated statements present
your viewers with a biased view and indicate malice on your part".
Mr Dorsey, an Arabic-speaking journalist, had then rejected WSG's demands,
and the court case is expected to clarify the circumstances in which
journalists can be compelled to reveal their sources.
